Retreat Terms and Conditions
Agreement overview
This document outlines the terms and conditions governing your participation in a wellbeing retreat organized by Happy Retreats (“the Organiser”) at El Parque, Ulea, Murcia (“the Host”). By participating, you (“you” or the “Participant”) agree to be bound by these terms. Please read them carefully before booking. These terms aim to ensure a safe and enjoyable experience for everyone while clarifying responsibilities and limitations.
Booking, payments & modifications
A non-refundable deposit is required upon booking. The remaining balance is due 10 weeks prior to the retreat start date. For retreats starting within 10 weeks, full payment is due at the time of booking. The Organiser reserves the right to modify or cancel any aspect of the retreat, including activities, services, itinerary, or class types, due to factors like vendor availability, weather, or unforeseen circumstances. No refunds will be provided for changes made under these circumstances.
Cancellation policy
The Organiser may cancel the retreat at any time. In the event of cancellation, you will receive a full refund of the amount paid. However, the Organiser will not be liable for any consequential losses, including preparation costs, travel expenses (airfare), or other damages. This policy protects both the Organiser and the Participant against unexpected events.
Travel insurance & responsibility
We strongly recommend obtaining appropriate travel insurance. You are solely responsible for securing insurance covering potential illness, injury, death, property damage, loss of belongings, cancellation, or other losses (“Losses”). The Organiser is not responsible for any losses you incur and is not an insurance provider.
Photography & media usage
The Organiser retains the right to use, reproduce, and distribute your image, likeness, and voice captured during the retreat for marketing and promotional purposes. You will be notified if your image is to be used and can opt-out. You waive the right to inspect or approve these materials and forgo any royalties or compensation. This release applies to all photos, audio, and video recordings.
Physical activity & health
Participation involves potentially strenuous physical activity, including walking, yoga, and swimming. You voluntarily assume all risks associated with these activities, including the possibility of injury or even death. You must be over 18 or have parental consent. You represent that you are in good health and free from any medical conditions that could affect your participation. Consulting a healthcare professional before attending is highly recommended.
Medical responsibility & care
You are financially responsible for all medical costs incurred during the retreat. The Organiser is not a medical practitioner and does not provide medical services. While there's no obligation to provide medical care, consent is granted for necessary treatment. You are advised to carry your own health insurance coverage. Please inform your doctor if you are pregnant and participating in the retreat.
Personal & retreat property
You are responsible for your own equipment and personal belongings. The Organiser and vendors are not liable for lost, stolen, or damaged items. Any damage to Host, Organiser or Vendor equipment or facilities resulting from your actions will be your financial responsibility.
Code of conduct
All participants are expected to adhere to the rules and regulations set by the Host, Organiser, and vendors. We require respect for all participants and a commitment to creating a positive and supportive environment for everyone’s wellbeing.
Liability waiver & indemnity
You fully assume all risks associated with the retreat and release the Organiser and its representatives from any liability for injuries, damages, or losses. You agree to indemnify and hold harmless the Organiser from any claims arising from your participation. This includes situations where the Organiser might be found negligent, unless it is due to gross negligence or willful misconduct.
Entire agreement & force majeure
This agreement constitutes the complete understanding between you and the Organiser. No oral agreements are valid. The Organiser is not liable for failures to perform its obligations due to events beyond its reasonable control, such as natural disasters or acts of war (Force Majeure).
Interpretation & severability
This agreement is intended to be interpreted broadly. If any part is deemed unenforceable, the remaining provisions will remain in effect. Failure to enforce any provision does not constitute a waiver of that provision.
